Why does the American form of government work?

"If a faction consists of less than a majority, relief is supplied by the republican principle, which enables the majority to defeat its sinister views by regular vote. It may clog the administration, it may convulse the society; but it will be unable to execute and mask its violence under the forms of the Constitution. When a majority is included in a faction, the form of popular government, on the other hand, enables it to sacrifice to its ruling passion or interest both the public good and the rights of other citizens. To secure the public good and private rights against the danger of such a faction, and at the same time to preserve the spirit and the form of popular government, is then the great object to which our inquiries are directed. Let me add that it is the great desideratum by which this form of government can be rescued from the opprobrium under which it has so long labored, and be recommended to the esteem and adoption of mankind." (Article #10)

This passage talks about how if there is a "faction" that does not have a majority vote they do not have to worry about the other factions that do have a majority vote beating them out because the republican principle will ensure that they all get an evan vote. This is not saying that the minority factions will always win or will win at all but it does in fact give them an evan vote with the majority factions. 


"It is equally evident, that the members of each department should be as little dependent as possible on those of the others, for the emoluments annexed to their offices. Were the executive magistrate, or the judges, not independent of the legislature in this particular, their independence in every other would be merely nominal." (Article #51)

I believe that this article is saying each department of the government should have to rely as little as possible on the other departments with in the government but if need be the departments can back up the other. This works for the american government because it creates checks and balances to insure that one department does not gain to much power.

  4. I think that the points you make are valid. What you said about the branches of government not having to rely on each other, yet supporting each other, is true. It is a good point that the branches of the government don't always need to regulate each other, and they do it in ways that may be hard to identify right away.
